# End User License Agreement (EULA) for Ask AI

                ## 1. Definitions

                ### 1.1 "Ask AI" 
                Refers to the software product provided by Open Windows Software Pty Ltd (ReadyTech).

                ### 1.2 "User"
                Refers to any individual or entity accessing or using the Ask AI software.

                ## 2. Acceptance of Agreement

                ### 2.1
                By accessing or using Ask AI, the User agrees to be bound by the terms and conditions set forth in this End User License Agreement.

                ## 3. License

                ### 3.1
                ReadyTech grants the User a non-exclusive, non-transferable license to use Ask AI in accordance with the terms and conditions of this Agreement.

                ## 4. Fees and Usage

                ### 4.1
                The User agrees to pay a flat monthly fee for usage of Ask AI, as outlined in the pricing plan provided by ReadyTech.

                ### 4.2
                In the event that the User's monthly token usage exceeds five (5) million tokens, the User agrees to pay an additional fee of one (1) cent (in AUD) per one (1) million tokens used beyond the initial five (5) million per month.

                ## 5. Reasonable Use Policy

                ### 5.1
                The User agrees to use Ask AI in a reasonable manner, consistent with its intended purpose. Unreasonable use includes but is not limited to excessive or abusive usage, or usage that violates applicable laws or regulations or what would be considered reasonable by a reasonable person.

                ## 6. Privacy and Data Protection

                ### 6.1
                ReadyTech adheres to all privacy and data protection rules and regulations applicable in Australia. The User's data and privacy rights are outlined in ReadyTech's Privacy Policy.

                ## 7. Liability

                ### 7.1
                ReadyTech shall not be liable for any damages or losses arising from the User's use of Ask AI, including but not limited to:
                - Any harm caused to the User's website or introduction of harmful code as a result of installing or using Ask AI.
                - Any false or misleading information provided by Ask AI, as it generates answers based on the information provided by the user and by the training material.

                ## 8. Termination

                ### 8.1
                ReadyTech reserves the right to immediately terminate the User's access to Ask AI in the event of unreasonable use or violation of this Agreement.

                ## 9. Collection and Aggregation of Data

                ### 9.1
                ReadyTech may collect and aggregate data related to the User's usage of Ask AI for the purpose of improving the software and providing better services to Users.

                ## 10. Changes to Pricing

                ### 10.1
                ReadyTech reserves the right to change the pricing for Ask AI with 30 days’ notice to the User.

                ## 11. Miscellaneous

                ### 11.1
                This Agreement constitutes the entire agreement between the parties concerning the subject matter herein and supersedes all prior agreements and understandings.

                ### 11.2
                This Agreement shall be governed by and construed in accordance with the laws of Australia.
